I went to see Merle live and his son Noel sang this song. Wow he sure sounds like his daddy.
Anyway before singing, he told a story about his father. Seems while Merle was in prison, this old cell mate was going to break out and Merle wanted to go with him. The old mate told him no he could not go with him and that he had to do his time get out of prison and play his music. Luckily for all country music fans, Merle didn't go with the old man.
The escapee killed a police officer in his capture and was sentenced to death for it. As he is walking to the death chamber, he asks the Warden if Merle can sing him a song. Merle does and then after, Merle writes this song and the rest is musical history.
