Robert Kossack esq has publicly posted on his blog that SC filed a separate lawsuit in Las Vegas against Tara King dba DJ Tara King Productions by the March 1st 2013 deadline.

http://www.rfcexpress.com/lawsuits/trad ... g/summary/

Here is the Kossack blog article:

According to Mr. Kossack's blog, he is representing Ms. King pro-bono.

Also if you need to refresh yourselves on what has happened in the original Las Vegas Lawsuit that was filed by Donna Boris at request of APS & Associates, allegedly against Slep-Tone's wishes, here is extensive Docket Text followed by the Dismissal Orders:

8) Refilled against one defendant Insane, what about all the other dismissed defendants? I guess they are going to refile against them? Just like they are going to be refiled against the 40 dismissed defendants in California? I guess we have to take it one case at a time now that SC has to file individually? Have an Insane day.

8) So what's the big deal Insane both sides withdrew, no contest? No mention of a settlement, with prejudice means the subject doesn't come up again, right?

Lone Ranger,

"with prejudice means the subject doesn't come up again, right?" not really, it just means this one incidence doesn't come up again. If SC were to find new "data" they could bring a new lawsuit.

and Harrington posted on the other forum "I can only confirm that Slep-Tone and Ellis Island (Fame Operating Company) have agreed to settle the dispute between them on terms they have agreed not to discuss."

Okay, done deal. The original Las Vegas lawsuit filed by Donna Boris is finished.

Slep-Tone is still alive. No sanctions, not guilty of contempt.

What's next for Las Vegas? New lawsuits?

Has Tara King answered the complaint filed on March 1st 2013?

Looks like Slep-Tone is not going away any time soon. I predict the Trademark lawsuits will keep on coming.

1) Sounds like SC barely made it out of their Las Vegas mess by the skin of their teeth...

So:

2) Unless they learned nothing, I would guess that they will not be dumb enough to start up with the big boys in Vegas again very soon...

Maybe they will note that the results of dealing with folks whose pockets are deeper than theirs can be disappointing. Deeper pockets also mean more on the line to protect.

Well Ellis Island has some deep pockets and they settled.

The PT Defendants had even deeper pockets and they settled as well.

Now that the APS/Boris fiasco is over in this case, it will be interesting to see how SC continues, in a more logical fashion, as it pursues thieves of their product in the Las Vegas area.

One lesson for sure that has been learned in this case, is to file lawsuits individually. It appears that Slep-Tone now has the capital to do so, as they have shown recently in Arizona and Oregon.

8) You don't know for a fact Insane SC got one dime from Ellis since the devil is in the details, and James cannot discuss the case? It is speculation on your part, since only the effected parties know what the nature of the agreement is. In blackjack this is called a push, neither a victory or a defeat can be claimed by either the certified or the non-certified camps. True everyone is settling, but no one knows for sure which side ran with their tail between their legal legs. You want to create the illusion SC came off as the winner, it is just as probable they are the loser. If things are going badly I wouldn't want the details out either. The true test will be to see if SC joins CB in the ranks of the defunct manus. Have a Insane day.

Maybe Secret Squirrel should go see if GEM series tracks are now being played during karaoke at Ellis Island!

Was just wondering the same thing--has there been a change in hosting companies or a change in the library or some other indication that it isn't just business as was usual.

Perhaps it is time for a Vegas trip to check out all the PT Defendants venues and Ellis Island.

It will be a secret! I hope I don't get too squirrely or end up in court!

Because it makes him feel better I guess. If SC is running away with their tail between their legs as many think they are losing left right and center, why then are they continuing on, considering the cost.

incorrect Tim.

because the judge made no decision, you two came to an agreement so someone had to back down from their stance. whichever side it was, someone backed down. you gave them the option to do an audit and they refused, went to court, and someone backed down.

8) Everyone is assuming James because you can't release the details of the settlement, duh? It could be you both decided to drop the matter, it could be they licensed your GEM series, since this is what I believe drives all this legal dog and pony show. It could be anything, and of course you sit in the all knowing seat, much like God and reveal that which you can reveal. Oh by the way March is nearly over did SC ever release the rehashed material, they said they would. I never use their product so don't follow the releases that closely. Have a legal day.

My guess is that SC wanted the non disclosure part of the deal since they are really the only ones that have something to lose with a stalemate being talked about.

Something like "we agree to drop all of the law suits as long as you defendants agree not to tell everyone that we caved in"

Had the Casinos caved and agreed to pay any kind of monetary settlement; Sound Choice would have wanted to toot their own horn all about it. And the Casinos have no reputation to defend when it comes to their Karaoke shows, while Sound Choice's legal standing takes a major hit if they admit defeat because their first BIG LOSS in the court room will spread like wild fire.

Whatever the Casinos did will get around to the defendants in the future. It's just a matter of time.

I would think that it has something to do with the ruling by the California judge that called the Sound Choice law suits nothing but a series of shake downs. I guess we'll just have to wait and see.

Looks ike Sound Choice will have to go back to chasing the little fish who can't afford legal representation. They seemed to have come up snake eyes when going after the truly big fish. They went for a big payday and walked away empty handed.

Had they actually won something; we'd never hear the end of it from the Cheer Leaders. I'm sure it would have been quickly leaked.

One more thing. I am NOT Chip Staley.

How about some common sense speculation...

When a suit is dismissed with prejudice, that means the court is done with it and the plaintiff is not allowed to revisit the matter.
In this case the end with prejudice was part of the negotiation to end the suit. Since ending it this way is good for the defendant and not so good for the plaintiff, it would seem the defendant had the leverage in the settlement.

I suspect the winner in the secret deal was the defendant and the only thing won by Slep-Tone was the secrecy of the deal (because secret deals have been the norm for Slep-Tone when they back down from their suits).
