...Okay, so last night, after viewing the topic titled " Sound Choice changes - and a new licensing program" ... I'll admit, I was a little confused, then frustrated, then ticked off after reading that initial announcement about the newly formed SC-Phoenix Company. Alright, so what got my blood pressure boiling? It was the part about the "window closed" for getting certified.

...However, after a short period of time, I thought to myself, "wait a minute, I made arrangements with a certain SC Rep (remaining nameless at this point), back in November of 2013 about the Chris Avis/SC Free Audit Offer viewtopic.php?f=1&t=28856&hilit=free+audits that was posted here at the Karaoke Scene Forums. Meaning I should be on the "To Be Audited" list.
...So I decided to investigate. Went looking for my back-up files of emails, receipts, conversations, websites, etc. (you know, sometimes a person tends to keep those types of items backed up, just in case ya need them in the future) and there they were, the copies of the emails with SC. Now throughout my communications with this unnamed SC Rep, he felt it would be best to do an "On-Site Audit" and would schedule an audit for me in the near future, only because I had a rather large collection (his words not mine). He stated he just needed time to line up a few more KJs in my area and said that he would call me when he was ready. He also stated since I was doing this voluntarily (meaning: no pending lawsuits filed against me), that I could play off of my digitally transferred tracks until the audit. Obviously any issues could results in a denial of Certification.
...***This also confirms with what is stated on the PEP Site: "After notifying us that you have media-shifted, you can consider yourself to have our provisional permission to use the media-shifted tracks. This is because we have limited resources and may not be able to schedule your audit immediately. However, once we notify you that we are ready to audit you, the audit must be completed within a reasonable time. Failure to agree to an audit date may result in our withdrawing the provisional permission." ... Again, am so thankful for backing up important emails and keeping logs of certain details in life! Ya just never know when you might need them, right?

...That interaction was back in November 2013. As of today, I'm still waiting for that audit date phone call.

...So, I guess, what I'm asking here is, am I still on "The List to Be Audited" or not?

That's all fine and dandy if you were dealing with Sound Choice and ONLY Sound Choice. What you quoted was in PEP's Website under "What is Sound Choice's policy on transferring songs off the original disc and onto a computer or other machine?" But, as far as PEP is concerned, if you were not a Certified KJ before now, they are not going to conduct an audit of your discs or Certify you.... You (MadMusicOne) may be an exception to that (based on what you can show within your "good faith" correspondence with Sound Choice).

...Cue, I hear ya and agree. But I suppose, at this point, it's a wait and see game for me.

...Perhaps SC/PEP is satisfied with their current customer base and feel like they have enough business to satisfy their future needs. I don't know? But do believe they should have left their audit system open for past and future hosts. Even if SC/PEP raised their fee for audits to make it worth their time, it would most likely be cheaper than $200.00 per month for KJs that have purchased legit discs but only wanted to transfer to a Hard Drive.

It looks like less than 350 kjs have been audited or bought the gem set. They might have a huge market if you cannot use the red logos anymore without paying monthly.

That could happen. There are several KJs in my market that never were certified and continue to use the SC brand and their acquisition of the track could be in question, but now with the new program and fees attached, I know of at least one that will not pay the fee because of his lack of funds and will continue to run his show until he is forced out since he has a very large SC library and never had the financial means to buy a legal library to start with (if you get what I am sayin') Now it really sucks to be him!

After looking at Chris' post from December that he linked, it made me remember that I never got my t-shirt and banner after leasing the Gem Series. I want them, and I want them now......... ;)
