Ok, first I'm a publisher artist with over a dozen labels books, music, films, music videos.

Second, I have heavy IP rights legal background.

SoundCloud is out of business.
PEP sold catalog to Stingray.
All they sue over now is unauthorized use of name, it's all they own.

They have to prove damage to name and a KJ promotes the name so it's fair use.

Lots of new karaoke publishers all on youtube so stream it's legal.

YouTube TOS doesn't prohibit streams for home use. Plus the TOS applies only to members. So anyone in the public domain can stream. Some new publishers with large YT accounts are doing direct use licensing, so it depends on what catalog you subscribe to.

ASCAP music covers all music at venue.

You can't copy files off YouTube for public use but streams ok if it's part of a catalog to a publisher selling DJs use rights

Lots of new companies involved with YT streaming.

You don't need them for home use. But use one if you want for public use.

STREAM
STREAM
STREAM

Digital Act was about copying and distribution of FILES.

Streams are not under Digital Act.

Learn to stream.

It's resolved the solution was streams

KNF, I couldn't agree with more on this quote. The song "Happy Trails" would be appropriate.

That's why every major DJ software is now tied to a streaming company.

The only DJs behind the times are kjs

So keep playing CD+g

You are definitely not up on things. You Tube videos can and have been downloaded. There are sites that do it online. Your statement that you can't download off of You Tube shows that you don't know crap.

You can't download and play as a DJ, that's illegal for commercial reuse like a DJ, now you can download, but not for DJ use only personal use, copying for commercial use is a Federal crime under Digital Act, yet streaming is not covered under Digital Act.

So a DJ CAN'T DOWNLOAD (for commercial use), but they can stream from lots of new publishers. I know the rules and it appears you don't even understand English.

Anything I watch or hear on a computer I can copy, and I have since the beginning of the net, I'm a geek, I can do anything on a computer. I theorized 6 dimensional computer languages at 16 in a think tank before PCs even existed. http://www.HolographicUniverses.com that's my work over 40 years old.

I'm GOD on a computer.

Haha and I sure know the rules.

Stream you CAN do as a DJ it's legal just join a streaming service.

Download you CAN'T DO as a DJ it violates the digital act.

You can physically do either but legally as a DJ you CAN'T DOWNLOAD and use publicly.

I guess English isn't your first language, it is mine, and I know 13 languages not including all the computer languages I know or created.

Now move on and apologize.

Reread my words, ask someone that comprehends English to help you.

You can't copy files off YouTube for PUBLIC USE but streams ok from streamers and many are on YouTube.

DO YOU UNDERSTAND NOW?

Magazine,

I'll be nice to you Warren, we grew up in same era.

Only in 1976 I started my first tech company pre pc era.

I'm an original artist with many Indy publishing labels I own, music, books and films.

Big thing I see here is a few dinosaurs that have .5% to 1% of all the posts here are steering new KJs to old tech and bad info about legal issues.

Now since my dad was a pioneer in tech with IBM from 50's era and since I grew up around old tech mainframes from 60's and 70's I have a vast tech background unlike anyone else in our generation.
We're both end of BB generation.

You don't post alot, I'm in studio all day so when I take a break last few days I've posted here.

I won't have the time or interest to post here much.

I'm too busy.

Now right now I'm concerned this forum is steering new KJs badly so that's my interest right now letting the rest of kjs here know about the seismic shift that's happening in all aspects of music and even film to streaming.

Some huge posters here are attacking me for saying wake up the future is streaming.

If I have to make 100 posts here so others start to realize this forum needs to move in that direction so be it.

If it means a few 1% posters attack me so be it.

Streaming is the future of music and films.

It's ready happened, now it will happen in KJ community too.

I've been mostly absent from this forum for quite some time, as I have stepped back from the day-to-day management of PEP and have been working on other projects. I don't have much time today, but this particular post needed a response.

Good for you.

Rexxx wrote:

So do I. I've been an intellectual property attorney for 16 years. I'm registered to practice before the U.S. Patent and Trademark Office in patent cases (since 2000), have written more than 100 patent applications in various technological areas, and have registered approximately 50 trademarks for various clients. I've litigated patent, trademark, and copyright cases before district courts in 15 different states and before the U.S. Courts of Appeals for the Fourth, Fifth, Sixth, Seventh, Ninth, Eleventh, and Federal circuits.

Rexxx wrote:

Nope. While they've had some cutbacks in recent years, SoundCloud is still in business.

Incorrect. In fact, we recently sued a number of defendants for infringement of our copyrights.

Rexxx wrote:

Incorrect. Proof of infringement requires proof of (1) a valid trademark and (2) use by the defendant of a confusingly similar mark. Trademark fair use requires, among other things, that the user of the mark be referring to the mark owner's goods or services and that the user use no more of the mark than is required to convey the information.

Rexxx wrote:

First of all, the term "karaoke publisher" has no recognized meaning. If you mean "karaoke producer," I'll point out that anyone can upload content to YouTube; doing so doesn't make it legal to stream the content. If you meant that music publishers have licensed their catalogs to YouTube--yes, that's true, I suppose, but that doesn't make streaming legal.

Rexxx wrote:

Also incorrect. From the YouTube TOS:

https://www.youtube.com/static?template=terms

YouTube Terms of Service wrote:
5. Your Use of Content
In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of Content.

A. The Content on the Service, and the trademarks, service marks and logos ("Marks") on the Service, are owned by or licensed to YouTube, subject to copyright and other intellectual property rights under the law.

B. Content is provided to you AS IS. You may access Content for your information and personal use solely as intended through the provided functionality of the Service and as permitted under these Terms of Service. You shall not download any Content unless you see a “download” or similar link displayed by YouTube on the Service for that Content. You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of YouTube or the respective licensors of the Content. YouTube and its licensors reserve all rights not expressly granted in and to the Service and the Content.

So, as you can see, exploiting the content commercially is expressly prohibited under the YouTube TOS, unless you have a licnese from the entity that owns the content.

Rexxx wrote:

No. A blanket license from ASCAP covers any composition copyright for which the performing rights are administered by ASCAP. It does not cover copyrights administered by BMI or SESAC, nor does it cover the copyright for any audiovisual works (which includes all karaoke works, unless, of course, you don't display anything on the screen--which makes karaoke pretty difficult).

Rexxx wrote:

No. See above.

Rexxx wrote:

Rexxx wrote:

I assume you're referring to the Digital Millennium Copyright Act. And yes, it did make some changes to the copyright laws regarding the distribution of files online, mostly by insulating online service providers (ISPs, platform websites, etc.) from liability as long as they follow certain protocols. It did not fundamentally alter the legality of distributing or commercially using content without a license from the owner of that content.

Rexxx wrote:

This is simply not true. The DMCA does not discriminate between "streaming" and "downloading" content.

It's an excellent solution, if what you're looking for is piracy. But let's not pretend it's something other than piracy.

So I believe Rexxx here is sitting back and laughing his butt off. I think he's yanking everybody's chain, which is why I never responded to his last post. No one can be that dumb and delusional, unless of course his mother dropped him on his head when he was a kid. If you have further doubts just listen to the thing he calls his "music", then there should be little doubt in anyone's mind that he is joking. Obviously doesn't know a db from a doughnut, and as is common with most people who release music void of musical intelligence, label it as "art". You know the kind of songs you wrote when you were in 5th grade to try and woo your grammar school crush on little Billie Bob Jo. But like I said, he can't possibly be serious and is just yanking everyone's chain while having a good laugh at people responding to his moronic posts.

Everything on YT is legal to stream for home use.

Most Pro KJ Players now offer a catalog to stream from a new publisher and most of these new DJ targeted streamers are on YT.

So DJs just use a stream service for DJs.

Karaoke Cloud n Net are two.

Karafun has a Pro Stream service for DJs.

So STREAM.

Home use it's all good.

Public use get a sub from one or more of the new streaming publishers.

Streaming is the future.

Streaming is happening legally now.

Anyone not streaming to home or to gigs is way behind the times.

Every player now pretty much is connected to a streaming catalog.

Many of them have huge accounts on YT.

The public streams for free, they charge minor fees to DJs to do pro streaming.

Almost 30k songs karafun now.

Karaoke Cloud 10k or so.

Stream people.

It's free for home use.

It's a minor monthly fee for DJs

Only problem with streaming is internet connection (even my hotspot glitches now and again) and sometimes losing licensing for individual tracks or artists in general - look at those that originally signed up for Digitrax with over 20K songs, since Sony (and maybe EMI or a couple others can't remember off hand) hit them they had to delete a great majority so they are down to around 1500 tracks. What was there one day might not be there the next. Now one like Party Tyme allows to download all content to work offline, but only is playable when service is paid.

Couldn't agree more! Stairway to Heaven was obviously a karaoke backing track, and the lyric swipes must have been way out or his ability to read! Maybe just taking some artistic liberty!

It's a minor monthly fee for DJs

it's a hell of a lot more for karaoke *$99/month for most with a decent catalog* , and the fatal flaw of streaming has just been proven TWICE in the last year.

Digitrax has their licensing pulled from Universal and BOOM you just lost over 50% of your catalog overnight. Can you imagine how pissed off a patron would be that he can't sing the same song he's been singing for the last 6 months because you no longer have it?

And just last week, I found out that the music streaming service that Dex3 from PCDJ uses, went out of business completely..

Boom now you have ZERO music to play for your DJ gigs AND you're out the $20 you spent for the whole month.

No thanks, I'll keep my catalog of $15,000 unique songs and keep buying the new ones because I will ALWAYS have my songs no matter how greedy the music publishers get and try to keep changing the rules to make more money.
