there was mention on another forum that PEP has filed suit against someone for Music Maestro.
has anyone heard of this?

8) I don't see how that could be possible, the president of MM was forced to stop production because of failure to pay fees owed to owners of copyright, as I remember the president of the company even had to do some jail time. At least that what I was told by the owner of the karaoke store I used to buy from. MM went under such a long time ago it must be in the freeware zone I would think. If this story is true then I think Jim or some other PEP spokes hole would be on this forum, informing aka bragging about this new source of potential income for PEP, don't you think? Even if PEP could manage to get rights to the MM label it would have the same status as CB or even less.

I have asked where the rumor started from the person who posted it. A simple trademark search says there is no registered trademark for Music Maestro or Music Maestro Karaoke from the original owners (Aldo Mimoun). The trademark is registered for paper music materials used in music instruction since 2013.

On Thursday, December 09, 2010, a U.S. federal trademark registration was filed for MUSIC MAESTRO by Oscar Lozano Jr, Arlington, TX 76011. The USPTO has given the MUSIC MAESTRO trademark serial number of 85194730. The current federal status of this trademark filing is REGISTERED. The correspondent listed for MUSIC MAESTRO is DAVID M. GOODSON of 313 W 4TH ST, HINSDALE, IL 60521-4027, . The MUSIC MAESTRO trademark is filed in the category of Paper Goods and Printed Material . The description provided to the USPTO for MUSIC MAESTRO is Paper teaching materials in the field of music; Printed instructional, educational, and teaching materials in the field of music; Printed teaching activity guides in the field of music; Printed teaching materials in the field of music.

I didn't know what a PEP was until a few weeks ago. Either way I wouldn't discuss lawsuit specifics in a public forum.

Actually, the question was about PEP acquiring the Pop Hits Monthly trademark. Is there any truth to that??

Sorry, but that's a can of worms I'm not looking to open. However trademark transfers are a matter or public record so I should think it would be easy enough to research that online.

There are other rules that are required for the successful SUPPLEMENTAL REGISTRATION of a "dead" or "zombie" trademark and one of those is proving that the mark is "used in commerce." This means that PEP would have to sell MM tracks... but even then, I don't know how far they'd get trying this kind of stunt. Especially if they just tried to register the logo as their own and then turn around and sue KJ's and venues for it. And it would be nothing more than a stunt to trick people in my opinion.

The trademark is dead. A registration now would prevent the (new) owner from proving ownership -- especially on a product that was never theirs at any time. See the graphic below.

It would be like re-registering the ancient "Nash" auto trademark and attempt to sue anyone that still owned one for some kind of infringement.

File comment: Good luck suing for infringement on MM tracks as a supplemental registration. There is a distinct validy and ownership problem.... just for starters.

If I have to pay for a PHM/SIN audit then that's it! I'll just wait till they go up like SC disks and sell off the whole mess. I'd be shocked if PEP bought PHM/SIN but if they did they might as well buy up THM/Panorama as well....

No worries ... PHM/THM/SIN will never conduct audits. BTW Panorama's THM was an infringement of Stellar's trademark which was settled before a judge in 2007. Panorama owned very little of the content. Much of it was licensed from catalogs. The songs that weren't were surrendered to Stellar in lieu of judgment when the total amount of damages weren't satisfied.

Sing It Now, I believe they were discs that were manufactured by Stellar and sold via Walmart. I believe some of the later PHM discs also said "Powered By Sing It Now", though feel free to correct me.

I have at least 24 SIN discs and they say "Sing It Now" on the cd. The numbering/labeling system was quite weird with "Spring", "Summer", "Winter" and "Fall" in the label name.

The reason for the "weird" numbering/labeling was because they were big box store products that were released 4 times per year. The very first SIN releases were in 2003 as monthly products but the inventory/returns logistics was a nightmare so we had to rethink the way they were racked and decided upon a seasonal release instead of monthly.

scroll down, click the browse button, select picture, "add the file", then you can place it in the email.
You may need to check the cursor position prior to "Place Inline" is clicked.
